These Terms and Conditions (“Terms”) govern access to and use of the Montenegro Real Estate Hub (“MREH”) website, related pages, forms, communications, and general website-related services made available through the website or directly through the MREH team.
By accessing or using the website, submitting an inquiry, requesting a property presentation, or otherwise interacting with MREH through the website, you confirm that you have read and accepted these Terms. If you do not agree, you must not use the website or the website-related services governed by these Terms.
These Terms apply to the website-use relationship and general pre-contractual interactions between you and MREH in connection with the website. Rules relating to the processing of personal data, cookies, direct marketing consent, and privacy rights are governed separately by the Privacy Policy and Cookies Policy, which form part of MREH’s legal documentation.
These Terms do not replace any separate written agreement, brokerage arrangement, reservation document, advisory engagement, NDA, or other transaction-specific document that may apply in an individual case.
Montenegro Real Estate Hub, also referred to as “MREH”, is a real estate and property promotion platform operated under the trading name/brand of Old Shatterhand DOO Podgorica, focused on presenting real estate opportunities in Montenegro and connecting interested buyers with relevant properties, partners, and related support services.
MREH acts primarily as a buyer-oriented intermediary, promotional, and coordination layer. Unless expressly stated otherwise in a separate written agreement, MREH is not the owner, developer, or direct seller of the properties displayed on the website. Property ownership, construction status, technical characteristics, legal documentation, availability, and final sale terms remain under the control of the relevant owner, investor, developer, or partner agency.
Promoters, advisors, and agents who act within the MREH system operate under the MREH brand and communication structure. External partners may participate in the supply of listings or in related professional services, but communication with prospective buyers may be coordinated through MREH.
The fact that a property, service, partner, or opportunity is presented through the website or MREH communication channels does not by itself mean that it is offered directly by MREH in its own name or under a single regulated professional status.
The website is intended to:
Unless MREH and the user enter into a separate written brokerage, advisory, reservation, viewing, or other service agreement, the content on the website is provided for general informational and pre-contractual communication purposes only.
Nothing on the website constitutes a binding offer, legal advice, tax advice, financial advice, valuation report, investment advice, or guarantee that a transaction will be completed.
Any transaction, reservation, engagement, or regulated service may be subject to separate written terms, additional verification, and the involvement of third-party owners, agencies, professionals, or service providers.
By using the website, you confirm that:
If you act on behalf of a company, family office, fund, or another person, you confirm that you are authorized to do so.
If MREH reasonably believes that information provided by you is false, incomplete, misleading, unauthorized, or abusive, MREH may refuse to process the inquiry, suspend communications, or take other reasonable protective measures consistent with these Terms and applicable law.
MREH aims to present property information carefully and in good faith. However, due to the nature of the real estate market, listing content may change frequently. Prices, availability, measurements, project timelines, specifications, ownership details, technical documentation, rental yield claims, development assumptions, photographs, renderings, amenities, and legal status may change or may depend on information provided by third parties.
For that reason:
MREH may, before a user enters a serious negotiation or transaction stage, perform an additional level of verification of material facts reasonably available to MREH through the owner, investor, partner agency, public records, or professional partners. However, unless expressly agreed in writing, MREH does not guarantee that every fact published on the website is complete, final, or continuously up to date.
Information confirmed directly by an MREH advisor or agent during an active purchase process may supersede earlier website content, but only to the extent expressly communicated for that specific property and stage of the transaction.
Website content should be understood as general and preliminary information intended to support initial property search, inquiry handling, and pre-contractual communication.
Users remain responsible for carrying out appropriate legal, financial, tax, technical, and commercial due diligence before making any binding decision or entering into any transaction.
Depending on the case, MREH may provide some or all of the following:
Unless expressly stated in writing, MREH does not act as:
Separate written agreements or transaction-specific documents may apply to certain users, properties, or stages of the relationship. Users remain responsible for obtaining independent legal, tax, financial, and technical advice before making any binding decision or entering into any real estate transaction.
Where regulated, licensed, or professional services are required, such services may be performed by appropriately authorized persons or independent third-party professionals, depending on the structure of the relevant case.
The website may refer to or connect users with third parties, including partner agencies, owners, developers, valuers, accountants, lawyers, translators, relocation partners, or external service providers.
Unless explicitly stated otherwise in writing:
MREH may receive a commission, referral fee, revenue share, or other commercial benefit from certain partner arrangements, where lawful and applicable. Where required by law or professional rules, MREH will provide relevant transparency.
Third-party services, partner pages, external tools, referral arrangements, or embedded or integrated services made available through or alongside the website may be subject to additional third-party terms, privacy notices, cookie notices, or contractual conditions.
The fact that MREH coordinates communication with a third party does not by itself make MREH responsible for that third party’s independent acts, omissions, representations, or regulated services.
MREH does not guarantee:
A real estate transaction depends on multiple legal, financial, technical, commercial, regulatory, and practical factors outside MREH’s direct control.
Any forward-looking information, yield indication, market context, investment narrative, relocation benefit, or residence-related information provided through the website or in preliminary communications is general in nature unless expressly confirmed otherwise in writing for a specific case.
Nothing in this section excludes or limits liability to the extent such exclusion or limitation is prohibited by mandatory law.
When communicating with MREH, the user must:
MREH may refuse inquiries, suspend communication, or terminate access where misuse, bad faith, indicators of fraud, or a legal risk reasonably exist.
Where reasonably necessary, MREH may also request clarification, additional information, or verification before continuing communications or processing an inquiry.
All content on the website, including text, branding, logos, selection and arrangement of listings, photographs, videos, graphics, design elements, databases, original descriptions, and editorial content, is protected by applicable intellectual property laws and belongs either to MREH or to the relevant rights holder who has authorized its use.
You may view and use website content for your personal, internal, and non-commercial property search, evaluation, and inquiry purposes only.
You may not copy, scrape, republish, distribute, modify, index, sell, reuse, frame, extract, mirror, or otherwise exploit the content without prior written consent, except where mandatory law allows otherwise.
No provision of these Terms grants any license, ownership right, or other right to use MREH’s name, branding, proprietary descriptions, listing structure, editorial materials, or other protected content except for the limited use expressly permitted above.
You must not:
MREH may modify, suspend, restrict, or discontinue all or part of the website, listings, features, forms, languages, visual presentation, technical integrations, or user flows at any time, with or without notice.
MREH may also update or change partner integrations, embedded services, referral tools, communication features, consent mechanisms, or other technical or commercial elements of the website from time to time.
MREH does not guarantee uninterrupted availability, error-free performance, or freedom from bugs, downtime, data delays, or compatibility issues. Reasonable technical, security, maintenance, or commercial updates may occur at any time.
Temporary interruptions, limitations, or changes may occur for security, maintenance, legal, compliance, operational, or third-party dependency reasons.
Nothing in this section excludes or limits liability to the extent such exclusion or limitation is prohibited by mandatory law.
To the maximum extent permitted by applicable law, MREH shall not be liable for:
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law, including liability for fraud, wilful misconduct, or any rights that cannot legally be waived.
If mandatory consumer law applies to a user, these Terms shall be interpreted in a manner consistent with that mandatory law.
You are responsible, to the extent permitted by applicable law, for losses, damages, costs, claims, or expenses caused by your unlawful misuse of the website, your infringement of third-party rights, your breach of these Terms, or knowingly false, misleading, unauthorized, or abusive information provided to MREH.
Nothing in this section shall be interpreted as excluding or limiting any rights that cannot legally be waived under mandatory law.
MREH processes personal data in accordance with its Privacy Policy, Cookies Policy, and applicable data protection law.
For full information on the categories of personal data processed, purposes of processing, legal bases, recipients, retention periods, international transfers, cookie and similar-technology practices, and data subject rights, users should consult the Privacy Policy and Cookies Policy.
By submitting an inquiry, using website forms, or communicating with MREH, you acknowledge that certain communications, lead-handling steps, partner-routing actions, or follow-up actions may be carried out in accordance with those policies and the applicable legal basis.
Where consent is required for certain communications, cookies, embedded services, affiliate tools, referral attribution tools, or similar technologies, MREH will rely on consent in accordance with applicable law and the relevant policy terms.
The website may contain links to third-party websites, materials, partner pages, embedded content, referral tools, affiliate tools, or other external resources or services.
MREH provides such links or access points for convenience, functional integration, or commercial coordination only and does not control or endorse all third-party content, services, or policies.
MREH is not responsible for the content, legal terms, privacy practices, cookie practices, availability, security, or performance of third-party websites or services acting independently of MREH.
Your interaction with a third-party website or service may be governed by that third party’s own terms, privacy notice, cookie notice, and contractual conditions.
MREH may, at its discretion and where reasonably justified, suspend, block, or terminate a user’s access to the website or communications if:
Where reasonably appropriate, MREH may also remove inquiries, restrict access, block IP addresses or other technical access points, request verification, or preserve relevant records for legal, security, compliance, or evidentiary purposes in accordance with applicable law and the Privacy Policy.
Any suspension, restriction, or termination under this section does not affect any rights, obligations, accrued claims, payment arrangements, confidentiality obligations, or separate contractual provisions that by their nature should survive.
These Terms are governed by the laws of Montenegro, except to the extent mandatory consumer protection, data protection, or other overriding mandatory rules of another applicable jurisdiction apply and cannot be contractually excluded.
Any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of Podgorica, Montenegro, unless mandatory law requires a different forum.
If any provision of these Terms is found unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force to the extent permitted by law.
Any unlawful, invalid, or unenforceable provision shall, where possible, be interpreted or limited so as to reflect its intended purpose as closely as possible while remaining valid and enforceable under applicable law.
These Terms govern website use and general pre-contractual interaction with MREH in connection with the website.
They do not replace any separate written contract, brokerage agreement, reservation document, NDA, service agreement, professional engagement, partner-specific arrangement, or other transaction-specific arrangement.
In case of conflict, the relevant transaction-specific written agreement prevails for the subject matter specifically regulated there.
MREH may update these Terms from time to time. The updated version takes effect upon publication on the website, unless a later effective date is specified.
Where required by applicable law, material changes will be appropriately communicated.
Updates may reflect legal, regulatory, technical, operational, commercial, partner-related, or website-functionality changes, including changes to forms, integrations, referral structures, communication flows, or related website services.
